Agreement to Terms

By accessing or using Altheo.care ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

Description of Service

Altheo.care is a platform that connects home care agencies with qualified caregivers. We provide tools for:

• Caregiver profile creation and credential management
• Shift posting and matching
• Schedule management and availability tracking
• Communication between agencies and caregivers

User Accounts

Account Creation

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful behavior.

User Responsibilities

For Caregivers

Caregivers agree to:

• Provide accurate information about qualifications and certifications
• Maintain current and valid credentials
• Honor shift commitments once accepted
• Provide professional, quality care services
• Comply with all applicable laws and regulations

For Agencies

Agencies agree to:

• Provide accurate shift information and requirements
• Comply with all employment and healthcare regulations
• Process caregiver payments according to agreed terms
• Maintain appropriate insurance and licensing
• Use caregiver information only for legitimate staffing purposes

Platform Relationship

Altheo.care serves as a technology platform connecting agencies and caregivers. We are not:

• An employer of caregivers
• A healthcare agency
• A staffing agency
• Responsible for the actual provision of care services

The relationship between agencies and caregivers is direct. Agencies are responsible for all employment decisions, compliance, and payment.

Payments and Fees

Agency Subscriptions

Agencies pay subscription fees to access the Platform. Fees are billed according to the selected plan and are non-refundable unless otherwise specified.

Caregiver Access

Caregivers can access and use the Platform at no charge. Altheo.care does not take a percentage of caregiver earnings.

Intellectual Property

The Platform, including all content, features, and functionality, is owned by Altheo.care and is protected by copyright, trademark, and other intellectual property laws.

Prohibited Conduct

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Submit false or misleading information
• Harass, abuse, or harm other users
• Interfere with the Platform's operation
• Attempt to gain unauthorized access to the Platform
• Use the Platform for any illegal or unauthorized purpose

Content and Data

User Content

You retain ownership of content you submit to the Platform. By submitting content, you grant us a license to use, store, and display it as necessary to provide our services.

Data Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTHEO.CARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

Indemnification

You agree to indemnify and hold harmless Altheo.care from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms are governed by the laws of the United States and the state in which Altheo.care is incorporated, without regard to conflict of law principles.

Severability
